These terms govern your use of the Biocharge platform operated by Biocharge Co., Ltd. [registration number and registered address to be inserted] (“Biocharge”, “we”, “us”). By creating an account you agree to them.
1. What Biocharge is
Biocharge is a health-optimization platform: blood testing through partner laboratories, interpretation of your biomarkers, a paid membership, and a marketplace of registered supplements. Biocharge is a technology platform, not a medical provider. Medical services are provided by licensed physicians practising through licensed medical facilities; every interpretation you receive has been approved by a licensed doctor before release.
2. Not for emergencies
Biocharge is not an emergency service and is not a substitute for seeing a doctor. If you have urgent symptoms, call emergency services (1669 in Thailand) or go to a hospital. Information on the platform supports — it does not replace — professional medical advice, diagnosis, or treatment from a physician who examines you.
3. Eligibility and accounts
You must be at least 18, resident in Thailand, and provide accurate information. You are responsible for keeping your login credentials secure and for activity on your account.
4. Membership and billing
- Membership is billed once a year at ฿4,990 for founding members (list price ฿5,990; the price may change with 30 days’ notice) and renews automatically each year until cancelled. Your first year includes one Basic blood panel; retests are bought at member cost.
- You can cancel anytime in settings; cancellation takes effect at the end of the paid period, and benefits continue until then.
- Payments are processed by our payment provider. Fees for completed periods are non-refundable except where Thai consumer law requires otherwise.
5. Testing services
Blood draws and laboratory analysis are performed by licensed partner laboratories. Test prices are shown before you order. Results are released to you through the platform after clinical review. You are responsible for attending scheduled draws; missed appointments may be rescheduled subject to the partner’s policy.
6. Interpretations and AI
Biomarker interpretations are prepared with the assistance of AI systems and are reviewed and approved by a licensed physician before you see them. They are educational health-optimization guidance based on your data — not a diagnosis, and not a prescription. Discuss significant findings, medication changes, or symptoms with a doctor.
7. Marketplace
Products sold through the marketplace are food supplements registered with the Thai FDA — not medicines. Product suggestions linked to your protocol are educational and approved through the same clinical review as interpretations. Follow label directions; stop and consult a doctor if you experience adverse effects. Delivery, returns, and defects are handled under Thai consumer-protection law.
8. Acceptable use
Do not misuse the platform: no unauthorized access, scraping, reselling of content, uploading of another person’s health data without authority, or use of the service for anyone under 18.
9. Intellectual property
The platform, brand, and content are owned by Biocharge or its licensors. Your data remains yours; you grant us the licence needed to operate the service for you, as described in the Privacy Policy.
10. Liability
To the extent Thai law allows, Biocharge’s liability for claims arising from the platform is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited under Thai law, including for gross negligence or willful misconduct. Clinical judgment on interpretations rests with the approving physician and their licensed facility.
11. Suspension and termination
You may close your account at any time. We may suspend or terminate accounts that break these terms or where required by law, refunding any unused prepaid period unless the termination is for misuse.
12. Changes
We may update these terms; material changes will be notified by email or in-app notice at least 15 days before they take effect. Continuing to use the service after that date means you accept the new terms.
13. Governing law
These terms are governed by the laws of Thailand, and disputes are subject to the courts of Thailand. Nothing in these terms limits your rights under Thai consumer-protection law.
